This document (as well as other documents mentioned here) regulates the conditions governing the use of this Website (www.starstickvinilos.com) and the purchase or acquisition of products on it (hereinafter, Conditions).

For the purposes of these Conditions, it is understood that the activity that StarStick SL develops through the Website includes the sale of decorative vinyl, prints and paintings, wallpapers and other decorative accessories for children and adults.

In addition to reading these Conditions, before accessing, browsing and/or using this web page, the User must have read the Legal Notice and the General Conditions of Use, including the cookie policy, and the privacy and data protection of StarStick SL. By using this Website or by making and/or requesting the purchase of a product through it, the User agrees to be bound by these Conditions and by all of the aforementioned, so if you do not agree with all of this, you should not use this Website.

Likewise, it is reported that these Conditions could be modified. The User is responsible for consulting them each time they access, browse and/or use the Website, since those in force at the time the purchase of products is requested will be applicable.

2. The User

The access, navigation and use of the Website, confers the condition of user (hereinafter referred to, indistinctly, individually as User or jointly as Users), for which reason, from the moment the navigation on the Website begins, all the Conditions established here, as well as their subsequent modifications, without prejudice to the application of the corresponding mandatory legal regulations as the case may be.

The User assumes his responsibility for the correct use of the Website. This responsibility will extend to:

3. Product and price information

StarStick SL reflects as accurately as possible the details and characteristics of the different products sold on this Website, even so, some characteristics may present variations between what is seen on the screen and the actual product. Colors may vary depending on the configuration and screen of each device.

The data included in each of the product sheets or in their photographs have a purely informative function. As a consequence, StarStick SL declines any responsibility for the appearance of errors in said information. If there are any, StarStick SL undertakes to take the measures within its power to correct the aforementioned errors or omissions after being informed of them. Every user has a 7-day right of withdrawal caused by the non-conformity of the products sold with their descriptive sheet or by the erroneous nature of the information contained in it.

The detailed measurements of the vinyls or other products offered in the online store www.starstickvinilos.com, may have a variation due to the printing, creation or handling process.

4. Purchase or acquisition process

Duly registered Users can buy on the Website by the established means and forms. They must follow the online purchase and/or acquisition procedure of www.starstickvinilos.com, during which several products can be selected and added to the cart, basket or final purchase space and, finally, click on: "BUY".

Likewise, the User must fill in and/or verify the information that is requested at each step, although, during the purchase process, before making the payment, the purchase data can be modified.

Next, the User will receive an email confirming that StarStick SL has received their order or purchase request and/or provision of the service, that is, the order confirmation. And, where appropriate, you will also be informed by email when your purchase is being shipped. Where appropriate, this information could also be made available to the User through their personal connection space to the Website.

5. Availability

All purchase orders received by StarStick SL through the Website are subject to the availability of the products and/or to the fact that no circumstance or cause of force majeure affects their supply. If there are difficulties regarding the supply of products or if there are no products in stock, StarStick SL undertakes to contact the User and refund any amount that may have been paid as an amount.

6. Prices and payments

The prices displayed on the Website are indicated in euros (€) and include taxes, unless by legal requirement, especially in relation to VAT, a different matter is indicated and applied. The prices of the products do not include transport costs. These expenses are shown in the final phase before placing the order. StarStick SL reserves the right to modify prices and specifications without prior notice. However, the prices are invoiced based on the prices shown at the time of order preparation, always in case there are sufficient stocks.

If the price of the product presented on the website is actually lower than the price paid by the User, the difference will be returned. If the price is higher, the client will be informed and will be able to accept or cancel his order.

Once an order is being prepared to be shipped, it cannot be cancelled.

The accepted means of payment will be: credit or debit card, PayPal, Payment in installments and bank transfer.

StarStick SL uses all means to guarantee the confidentiality and security of the payment data transmitted by the User during transactions through the Website. As such, the Website uses a secure payment system SSL (Secure Socket Layer).

6.1 Card payment

StarStick SL uses the CaixaBank – La Caixa Virtual POS, and accepts payments with Visa, MasterCard and JCB brand cards.

The virtual POS is a device prepared to make sales safely over the Internet, and it works as follows:

A.- If the financial institution so decides, it will try to contact the bank that issued the card to request the authentication of the cardholder (identity verification) before requesting the corresponding authorization request. In this way it can be guaranteed that only the genuine holder, owner of the card, will be able to operate with it.

B.- Implements SSL in all communications that prevent the interception of information by third parties. Therefore, confidentiality is ensured in all communications established during the transaction.

C.- It also enables mechanisms to prove the authenticity of the origin of the transactions and that also prevent the manipulation of data by third parties. This ensures the integrity of the transaction data.

D.- The card data is not normally known by the merchant, thus preventing this information from being used fraudulently by third parties. This information is conveniently stored by the Virtual POS, which in turn will provide it to the payment system when necessary (for example, in a return).

Therefore, all transactions carried out through the Virtual POS will have all the guarantees of security, confidentiality and integrity for the participating agents: cardholders and their issuing entities, and businesses and their acquiring entities.

6.2 Payment by transfer

The bank account number will also appear on the order confirmation screen and will also be sent by email to be able to make the deposit for the corresponding amount. Once the amount has been entered, StarStick SL begins to manage the order. Some transfers do not become effective until at least 48 hours (business days) after the deposit. If after 10 business days StarStick SL has not received the payment, the order will be cancelled.

6.3 PayPal

The User can also make the purchase payment with his PayPal account. In the case of selecting this payment method, the User will be redirected to the secure PayPal page, where they must enter their credentials and accept the payment. Once the payment is confirmed, the User will be returned to the StarStick SL Website, where they can verify the purchase made.

7. Delivery

StarStick SL makes shipments in different countries of the world. To see the zones and prices of shipments, you can consult the following link .

Shipping costs assume only a part of the total cost of shipping and logistics preparation of the package. In orders for several items, a single shipment will be made that will correspond to the item whose delivery time is longer.

Except for those cases in which there are unforeseen or extraordinary circumstances or, where appropriate, derived from the personalization of the products, the order will be delivered within the period indicated on the Website according to the shipping method selected by the User.

If the delivery period is very different from that indicated on the website, StarStick SL will contact the user by email or phone call to inform them of the actual period. The latter may choose to go ahead with the purchase by establishing a new delivery date or cancel the order with a full refund of the price paid. However, the modification of the delivery period initially indicated will not imply any compensation.

In any case, home deliveries are made on working days.

If it is impossible to deliver the order due to the User's absence, the order may be returned to the warehouse. However, the carrier would leave a notice explaining where the order is and how to get it delivered again.

If the User is not going to be at the place of delivery in the agreed time slot, they must contact StarStick SL to arrange delivery on another day.

In the event that 30 days have elapsed since your order is available for delivery, and it has not been delivered for reasons not attributable to StarStick SL, StarStick SL will understand that the User wishes to withdraw from the contract and it will be considered terminated. As a consequence of the termination of the contract, all payments received from the User will be returned, with the exception of shipping costs and/or additional expenses resulting from the return of the package to StarStick SL facilities.

For the purposes of these Conditions, it will be understood that the delivery has taken place or that the order has been delivered at the moment in which the User or a third party indicated by the User acquires material possession of the products, which will be accredited by the signature of the receipt of the order at the agreed delivery address.

It is the responsibility of the recipient to verify the products upon receipt of the same and expose all the exceptions and claims that may be justified. The client will have 24 hours to verify the integrity of all the components of the product as well as verify that it includes all the accessories indicated on the product page. After that time, the integrity and content of the product will be considered accepted.

The risks that may arise from the products will be borne by the User from the moment of delivery. The User acquires ownership of the products when StarStick SL receives full payment of all amounts owed in relation to the purchase or acquisition made, including shipping costs, or at the time of delivery, if it takes place in a moment after the full receipt of the amount paid by StarStick SL.

In accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax (VAT), purchase orders for delivery will be understood to be located in the Spanish VAT application territory if the delivery address It is in Spanish territory except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at all times depending on the specific item in question.

If the delivery address is in a country outside the EU, the package must pass customs and may be subject to taxes. In this case, the DUA expenses will be borne by the buyer.

Shipments to the Canary Islands are subject to payment of import duties and taxes, as well as local customs. All these charges will be borne by the buyer.

7.1 Shipments by agency

In the Shipping section you can see the term and amount of the shipment according to the delivery area.

Shipping costs are free for Spain (except islands) from €50 of purchase, orders under €50 have a cost of €3.50 for Spain (except islands).

The estimated delivery time is 2-7 days.

The User will be able to follow all the stages of the shipment, from the moment of purchase to delivery, from the Menu / My orders.

The package will be delivered by hand to the address indicated by the User at the time of purchase.

In the event that no one can collect the package at the time of delivery, the delivery person will leave a transit note in the mailbox and the User will have to contact the transport company to agree on a new delivery time.

If after 7 days from the first delivery attempt the User does not contact the transport company, the package will be returned to the StarStick SL facilities. In this case, the User may request the payment of the purchase or the forwarding of the package. In both cases, shipping costs will be borne by the User. If the User wishes to pay for the order, StarStick SL will return the total amount of the purchase minus the shipping costs, since the transport service will have already been carried out. If, on the contrary, the User wishes to have the package forwarded, it will be he who must contract a new courier service.

7.2 Shipments by Postal Service

Small packages contracted through Correos Postal (ordinary Post Office) have a delivery time of 5-8 days, once the product has been manufactured. This type of transport does not allow the tracking of the package and the delivery is not made by hand, the package will be left in the mailbox.

7.3 Shipments by Mondial relay or point de livraison

Users from some European countries can choose Mundial Relay as the delivery system.

This type of shipments deliver the packages at Punto Pack® delivery points or at the address of the recipient.

The User will receive a message indicating the place of collection and the PIN number of the package. This PIN code is sent to the recipient by email or SMS and will be requested by the Point Relais merchant to collect the package.

8. Technical means to correct errors

The User is informed that in the event that he detects that an error has occurred when entering the data necessary to process his purchase request on the Website, he may modify them by contacting StarStick SL through the contact spaces enabled on the Website, and, where appropriate, through those authorized to contact customer service, and/or using the contact details provided in the first clause (General Information). Likewise, this information could also be corrected by the User through his personal connection space to the Website.

In any case, the User, before clicking on "BUY", has access to the space, cart, or basket where their purchase requests are recorded and can make changes.

Similarly, the User is referred to consult the Legal Notice and General Conditions of Use and, specifically, the Privacy Policy to obtain more information on how to exercise their right of rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data (RGPD) and in Organic Law 3/2018, of December 5, Protection of Personal Data and guarantee of digital rights.

9. Refund - Return - Withdrawal

The User has 14 days, from the reception of the package, to make the total or partial return of the order.

You can only return products that are in perfect condition and in their original packaging. Personalized products (with name or color), used products or already manipulated vinyls cannot be returned.

All StarStick wallpapers are made to order, being exempt from withdrawal. If the papers received have any errors or manufacturing defects, StarStick will be responsible for their return, but if the product is received in perfect condition, no changes will be made since they are considered personalized products.

If the product is defective or wrong, you can request a return as long as it has not been tampered with. Once the customer installs or manipulates the product, it cannot be returned under any circumstances.

The transport costs derived from the return of the product will be borne by the User, provided that the product is not defective or erroneous.

The user has two options to deliver the product to the facilities of StarStick SL

The User hires any transport agency and sends the package to the following postal address:

StarStick SL offers the package management and collection service. The service has a cost of €5 and with it the User only has to print a label and paste it on top of the package.

Once the merchandise is received and verified that it is in perfect condition, the refund of the amount of the product (without shipping costs) is processed with the same system that the payment was made.

9. Guarantees

StarStick SL guarantees that it can sell products and services from the www.starstickvinilos.com Website, and that it has the necessary technique to carry out the different online transactions.

The different products that can be purchased through its Website have the mandatory manufacturer's guarantee in terms of quality or operation. StarStick SL does not grant any guarantee on third party products or services.

StarStick SL makes its best efforts so that the information that appears is correct, but cannot guarantee the accuracy of the descriptions. Products may vary slightly in terms of specifications, colors, or other design features.

The User will be responsible, unless otherwise indicated, for transportation, telephone, mail and other expenses incurred during the warranty period.

10. Disclaimer

Unless otherwise provided by law, StarStick SL will not accept any responsibility for the following losses, regardless of their origin:

any losses that were not attributable to any breach by you;

business losses (including lost profits, revenue, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred); or of

any other indirect loss that was not reasonably foreseeable by both parties at the time the contract for the sale of the products was formalized between both parties.

Similarly, StarStick SL also limits its liability in the following cases:

StarStick SL applies all the measures related to providing a faithful display of the product on the Website, however it is not responsible for the slightest differences or inaccuracies that may exist due to lack of screen resolution, or problems with the browser used or others of this kind.

StarStick SL will act with the utmost diligence in order to make available to the company in charge of transporting the product that is the object of the purchase order. However, it is not responsible for damages arising from a malfunction of the transport, especially due to causes such as strikes, highway retentions, and in general any other typical of the sector, which derive in delays, losses or theft of the product.

Technical failures that, due to fortuitous or other causes, prevent the normal operation of the service through the Internet. Lack of availability of the Website for maintenance or other reasons, which prevents the availability of the service. StarStick SL puts all the means at its disposal in order to carry out the process of purchase, payment and shipping/delivery of the products, however it is exempt from liability for causes that are not attributable to it, acts of God or force majeure.

StarStick SL will not be responsible for the misuse and/or wear of the products that have been used by the User. At the same time, StarStick SL will not be responsible for an erroneous return made by the User. It is the User's responsibility to return the correct product.

In general, StarStick SL will not be responsible for any breach or delay in the fulfillment of any of the obligations assumed, when it is due to events that are beyond its reasonable control, that is, due to force majeure, and this may include, by way of example but not exhaustive:

Strikes, lockouts or other industrial action.

Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat or preparations for war.

Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.

Impossibility of using trains, ships, planes, motor transport or other means of transport, public or private.

Inability to use public or private telecommunication systems.

Acts, decrees, legislation, regulations or restrictions of any government or public authority.

In this way, the obligations will be suspended during the period in which the cause of force majeure continues, and StarStick SL will have an extension in the term to fulfill them for a period of time equal to the duration of the cause of force majeure. StarStick SL will use all reasonable means to find a solution that allows it to comply with its obligations despite the force majeure event.

11. Written Communications and Notices

By using this Website, the User accepts that most of the communications with StarStick SL are electronic (email or notices published on the Website).

For contractual purposes, the User agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information and other communications that StarStick SL sends electronically comply with the legal requirements of being in writing. This condition will not affect the rights recognized by law to the User.

The User can send notifications and/or communicate with StarStick SL through the contact details provided in these Conditions and, where appropriate, through the contact spaces on the Website.

Likewise, unless otherwise stipulated, StarStick SL may contact and/or notify the User via email or at the postal address provided.

12. Waiver

No waiver by StarStick SL of a specific legal right or action or the lack of a requirement by StarStick SL for strict compliance by the User with any of its obligations will mean, nor a waiver of other rights or actions derived from a contract or the Conditions, nor will it exonerate the User from the fulfillment of its obligations.

No waiver by StarStick SL of any of these Conditions or of the rights or actions derived from a contract will take effect, unless it is expressly established that it is a waiver and it is formalized and communicated to the User in writing.

13. Nullity

If any of these Conditions were declared null and void by a firm resolution issued by a competent authority, the rest of the clauses will remain in force, without being affected by said declaration of nullity.

14. Entire Agreement

These Conditions and any document to which express reference is made in these constitute the entire existing agreement between the User and StarStick SL in relation to the object of sale and replace any other prior agreement, agreement or promise agreed verbally or in writing by the same parts.

The User and StarStick SL acknowledge having consented to the conclusion of a contract without having relied on any statement or promise made by the other party, except for what is expressly mentioned in these Conditions.

15. Data protection

The information or data of a personal nature that the User provides to StarStick SL in the course of a transaction on the Website, will be treated in accordance with the provisions of the Privacy Policy or data protection (contained, where appropriate, in the Legal Notice and General Conditions of Use). By accessing, browsing and/or using the Website, the User consents to the processing of said information and data and declares that all the information or data provided is true.

16. Applicable law and jurisdiction

The access, navigation and/or use of this Website and the contracts for the purchase of products through it will be governed by Spanish legislation. Any controversy, problem or disagreement that arises or is related to the access, navigation and/or use of the Website, or with the interpretation and execution of these Conditions, or with the sales contracts between StarStick SL and the User, will be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.
